Terms & Conditions

These Terms and Conditions (the “Terms”) govern access to and use of https://www.topshelfbookstore.com/, https://www.topshelfbookbar.com/, related online services, customer accounts, purchases, mobile-store transactions, events, and other services offered by Top Shelf Bookstore LLC (“Top Shelf,” “we,” “us,” or “our”).

By accessing a Site, creating an account, submitting content, placing an order, registering for an event, or purchasing a subscription, you agree to these Terms and all policies incorporated by reference. If you do not agree, do not use the Sites or services.

1. Eligibility

The Sites are intended for adults. You must be at least 18 years old, or the age of legal majority where you live, to create an account or make a purchase. The Sites are not directed to children under 13, and children under 13 may not create accounts, place orders, submit reviews, or provide personal information. Adults may purchase children’s products for minors.

2. Accounts and security

You are responsible for providing accurate, current information; safeguarding your login credentials; and all activity under your account. Notify us promptly at topshelfbooksbar@gmail.com of suspected unauthorized use. We may suspend or close accounts reasonably believed to be fraudulent, abusive, unlawful, or in violation of these Terms.

Saved payment features are provided through third-party payment services. Top Shelf does not promise that any third-party service will always be available and does not independently store complete payment-card numbers unless expressly stated.

3. Product information and availability

We make reasonable efforts to present accurate descriptions, formats, images, colors, prices, inventory, special-edition features, signatures, sprayed edges, and availability. Screens and photography may display colors differently. Accessories and curated-package contents may vary where the product page discloses substitutions.

A product is not guaranteed until payment is accepted and the order is confirmed. We may correct genuine typographical, technical, inventory, or pricing errors and may cancel and refund an affected order. We will not substitute a materially different product without the customer’s consent.

4. Prices, taxes and payment

Prices are shown in the currency presented at checkout and may change prospectively. Applicable sales tax, shipping, delivery fees, and other disclosed charges are added before purchase. We accept the payment methods displayed at checkout or at the mobile store, which may include major credit and debit cards, Cash App, Affirm, and other processors.

Third-party financing, payment, fraud-screening, and installment services are governed by their own terms and privacy practices. Top Shelf is not the lender for Affirm transactions.

5. Orders

An order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons including lack of inventory, payment failure, suspected fraud, shipping restrictions, obvious error, abusive conduct, or legal compliance. If we cancel after payment, we will return the amount owed to the original payment method.

Requests to modify or cancel an ordinary order must be sent within 24 hours. We cannot guarantee modification or cancellation once fulfillment begins. Personalized, subscription, preorder, special-order, and other final-sale terms remain subject to applicable law and the product-specific policy.

6. Shipping and fulfillment

Shipping, local pickup, local delivery, delay, carrier-claim, address, and undelivered-order rules are stated in the Shipping, Pickup and Local Delivery Policy. If we cannot ship within the promised time, we will seek consent to a revised shipment date when required or issue a prompt refund as required by law.

7. Returns and refunds

The Returns and Refunds Policy is incorporated into these Terms. A “final sale” designation does not remove any nonwaivable legal remedy for an item that is not shipped, is materially misdescribed, is incorrect, or arrives damaged or defective.

8. Subscriptions

Subscriptions automatically renew and create recurring charges. Before purchase, subscribers must agree to the separate Subscription and Automatic-Renewal Terms, including price, billing frequency, charge date, customization, cancellation deadline, and refund terms. If those terms conflict with these general Terms, the subscription-specific terms control for the subscription.

9. Gift cards and rewards

Digital gift cards and loyalty rewards are governed by the Gift Card and Loyalty Rewards Terms. Rewards are promotional, have no cash value, and are not transferable. Gift cards are not rewards and remain subject to applicable gift-card law.

10. Reviews and other customer content

Customers may submit reviews, comments, photographs, social-media tags, and other content. The Reviews and Customer Content Terms govern this content and the license granted to Top Shelf. You may not submit content that is unlawful, deceptive, infringing, threatening, harassing, discriminatory, obscene, malicious, privacy-invasive, or unrelated to the product or service.

11. Intellectual property

The Sites and their original text, branding, logos, graphics, photographs, videos, page design, and other content are owned by or licensed to Top Shelf and protected by applicable law. “Top Shelf Bookstore,” “Where Fantasy Finds You,” and associated brand elements may not be used in a way that suggests sponsorship or affiliation without written permission.

You may use the Sites for personal, noncommercial shopping and informational purposes. You may not copy, scrape, reproduce, republish, sell, reverse engineer, interfere with, or exploit Site content or systems except as permitted by law or written authorization.

12. Third-party services and links

The Sites may link to or integrate with Wix, Square, Affirm, Cash App, Shippo, USPS, UPS, Google, Bookshop.org, Libro.fm, social-media platforms, and other providers. Their services are governed by their own terms and privacy policies. Purchases placed through Bookshop.org or Libro.fm are processed and serviced by those platforms, even when they financially support Top Shelf.

13. Events and mobile-store operations

Event schedules, locations, vendors, activities, products, accessibility arrangements, and participation requirements may change. Host-venue rules also apply. Event tickets, crafts, book clubs, and mobile-store participation are subject to the Events, Book Club and Mobile Store Terms.

14. Prohibited conduct
  • Use the Sites or services for fraud, unlawful activity, harassment, impersonation, or infringement.

  • Attempt unauthorized access, introduce malicious code, disrupt service, or evade security controls.

  • Use automated tools to scrape prices, inventory, customer data, or protected content without permission.

  • Abuse promotions, rewards, refunds, chargebacks, subscriptions, or customer-service processes.

  • Resell products in violation of a clearly disclosed purchase limit or contractual restriction.

15. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TOP SHELF DOES NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT EVERY CURATED BOOK WILL MATCH A CUSTOMER’S PERSONAL TASTE.

BOOK RECOMMENDATIONS, PRODUCT DESCRIPTIONS, REVIEWS, AND CONTENT ARE FOR GENERAL INFORMATION AND ENTERTAINMENT. TOP SHELF DOES NOT PROVIDE MEDICAL, ALLERGY, LEGAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOP SHELF AND ITS MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SITES OR SERVICES. TOP SHELF’S AGGREGATE LIABILITY FOR A CLAIM WILL NOT EXCEED THE AMOUNT THE CUSTOMER PAID TO TOP SHELF FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited, and do not exclude liability that cannot legally be waived, including liability resulting from fraud, willful misconduct, or other nonwaivable rights.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Top Shelf from third-party claims, damages, and reasonable costs arising from your unlawful conduct, your content, your infringement of another person’s rights, or your material violation of these Terms. This provision does not require a consumer to indemnify Top Shelf for Top Shelf’s own unlawful conduct.

18. Governing law and venue

Texas law governs these Terms, without regard to conflict-of-law principles. Any dispute not resolved informally must be brought in a court of competent jurisdiction located in Brazoria County, Texas, unless applicable consumer law requires otherwise. Both parties consent to that venue and jurisdiction.

19. Changes

We may update these Terms prospectively. The effective date will identify the current version. Material changes will be communicated as required by law. Changes do not retroactively alter a completed purchase, and material subscription changes will be handled under the Subscription Terms and applicable consent requirements.

20. Severability; waiver; assignment

If a provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision is not a waiver. Customers may not assign these Terms without written consent; Top Shelf may assign them in connection with a merger, sale, reorganization, or transfer of the business, subject to applicable privacy and consumer law.
